1. Agreement to Terms

Welcome to PixFocal ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our AI-powered product photography service, including our website at app.pixfocal.com (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• You will comply with these Terms and all applicable laws
• All information you provide is accurate, current, and complete

3. Account Registration

3.1 Creating an Account

To use the Service, you must create an account using Google OAuth authentication. You agree to:

• Provide accurate and complete information
• Maintain the security of your account
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

3.2 Account Termination

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the Service or other users
• Non-payment of fees

4. Service Description

PixFocal provides an AI-powered image processing service that creates professional ghost mannequin product photography. The Service includes:

• Image upload and processing using AI technology
• Ghost mannequin effect generation
• Image download and storage
• Credit-based usage system
• Subscription plans for regular users

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

5. Credits and Payment Terms

5.1 Free Credits

New users receive 3 free credits upon account creation. Free credits:

• Are non-transferable and non-refundable
• Do not expire unless account is inactive for 6+ months
• Are provided as-is with no guarantee of quality or results

5.2 Paid Credits and Subscriptions

You can purchase additional credits through subscription plans:

• Starter Plan: 40 credits/month for $29/month
• Professional Plan: 90 credits/month for $59/month
• Business Plan: 250 credits/month for $149/month

5.3 Payment Processing

Payments are processed by Stripe. By making a purchase, you agree to:

• Provide accurate payment information
• Authorize us to charge your payment method
• Pay all fees and applicable taxes

5.4 Subscription Billing

Subscriptions automatically renew monthly unless canceled. Important terms:

• Credits reset to plan amount at each billing cycle
• Unused credits do not roll over to the next month
• You can cancel anytime - access continues until end of billing period
• No refunds for partial months or unused credits

5.5 Credit Refunds

Credits are automatically refunded if:

• Image processing fails due to our system error
• Processing takes longer than 10 minutes (timeout)
• Service is unavailable at time of processing

Credits are NOT refunded for:

• User dissatisfaction with results
• User error (wrong image uploaded, etc.)
• Image quality issues from source file

6. User Content and License

6.1 Your Content

You retain all ownership rights to images you upload ("Your Content"). By uploading Your Content, you grant us a limited, non-exclusive license to:

• Store and process your images using our AI service
• Create derivative works (processed images)
• Display processed images to you within the Service

6.2 Content Restrictions

You may not upload content that:

• Violates any third-party rights (copyright, trademark, privacy)
• Contains illegal material or promotes illegal activity
• Contains offensive, obscene, or inappropriate content
• Contains malware, viruses, or harmful code
• Violates any applicable laws or regulations

6.3 Data Retention

Processed images are stored for up to 90 days. You can download your images at any time. We may delete images after 90 days without notice.

7. Acceptable Use Policy

You agree NOT to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Use automated tools to access the Service (bots, scrapers)
• Reverse engineer or attempt to extract source code
• Resell or redistribute the Service without permission
• Abuse the free trial or credit system
• Share your account credentials with others
• Use the Service to process images you don't have rights to

8. Intellectual Property Rights

8.1 Our Property

The Service, including its design, code, features, and branding, is owned by PixFocal and protected by copyright, trademark, and other intellectual property laws.

8.2 Processed Images

You own the processed images created by our Service. We do not claim ownership of your output images. However, you grant us the right to use anonymized, aggregated data to improve our AI models.

9. Disclaimers and Limitations

9.1 No Warranties

We do not guarantee that:

• The Service will meet your expectations or requirements
• Results will be error-free, accurate, or of a specific quality
• The Service will be uninterrupted or available at all times
• Any errors or defects will be corrected

9.2 AI Technology Limitations

Our Service uses AI technology which may produce inconsistent or unexpected results. Quality depends on input image quality, and we cannot guarantee specific outcomes.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIXFOCAL SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, goodwill, or business opportunities
• Service interruptions or unavailability
• Quality or accuracy of processed images
• Third-party actions or failures

Our total liability to you for any claims shall not exceed the amount you paid us in the past 12 months, or $100, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless PixFocal and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload to the Service

12. Dispute Resolution

12.1 Informal Resolution

Before filing a claim, you agree to contact us at hello@pixfocal.com to resolve the dispute informally. We will attempt to resolve the dispute within 30 days.

12.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

12.3 Arbitration

Any disputes not resolved informally shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules. You waive your right to participate in class-action lawsuits.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Updating the "Last Updated" date
• Sending an email notification (for significant changes)

Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. General Provisions

14.1 Entire Agreement

These Terms constitute the entire agreement between you and PixFocal regarding the Service.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14.3 No Waiver

Our failure to enforce any right or provision shall not constitute a waiver of that right.

14.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms to any affiliate or successor.
